Welcome to VapTales (the “Platform”). The Platform is provided and controlled by VapTales, Inc. (“VapTales”, “we”, “company”, or “us”). We are committed to protecting and respecting your privacy. You must be over the age of 13 to use our Platform.
Basic Information
When you sign up for or use VapTales you voluntarily share certain information including your name, email address, phone number, photos, videos, posts, and any other information including user generated content you provide us. You can also choose to share your precise location using your device settings or through photos. We will still use your IP address, which is used to approximate your location, (required to give proximity location data to the customized maps) even if you don't choose to share your precise location. We may use your information to facilitate sales, promotion, and purchases of goods and services and to provide user support.
Technical information
When you use a website, mobile application or other internet service, certain internet and electronic network activity information gets created and logged automatically. This is also true when you use VapTales. Here are some of the types of information we collect:
Log data
When you use our service, our servers record information (“log data”), including information that you automatically send whenever you visit a website, or that your mobile app automatically sends when you’re using it. This log data includes your Internet Protocol(IP) address (which we use to infer your approximate location), the address of and activity on the application, unique device identifiers, browsing and Posts history (including content you have created and viewed on the Platform), and Cookies how you used VapTales, cookie data and device data.
Metadata
When you upload or create User Content, you automatically upload certain metadata that is connected to the User Content. Metadata describes other data and provides information about your User Content that will not always be evident to the viewer. In connection with your User Content the metadata can describe how, when, where, and by whom the piece of User Content was created, collected, or modified and how that content is formatted. It also includes information, such as your account name, that enables other users to trace back the User Content to your user account. Additionally, metadata includes data that you choose to provide with your User Content.
Cookies
We and our service providers and business partners use cookies and other similar technologies (e.g. web beacons, flash cookies, etc.) (“Cookies”) to automatically collect information, measure and analyze which posts and advertisements you click on and how you use the Platform, enhance your experience using the Platform, improve the Platform, provide you with advertising on the Platform and elsewhere across your devices, and measure the effectiveness of advertisements. Cookies enable the Platform to provide certain features and functionality.
We and our service providers and business partners may link your contact or account information with your activity on and off our Platform across all your devices, using your email or other login or device information. Our service providers and business partners may use this information to display advertisements on our Platform and elsewhere online and across your devices tailored to your interests, preferences, and characteristics. We are not responsible for the privacy practices of these service providers and business partners, and the information practices of these service providers and business partners are not covered by this Privacy Policy.
Legal Reasons
We may disclose any of the information we collect to respond to subpoenas, court orders, legal process, law enforcement requests, legal claims, or government inquiries, and to protect and defend the rights, interests, safety, and security of VapTales, Inc., the Platform, our affiliates, users, or the public. We may also share any of the information we collect to enforce any terms applicable to the Platform, to exercise or defend any legal claims, and comply with any applicable law.
How long we keep your information
We keep your information only so long as we need it to provide VapTales services to you and fulfill the purposes described in this policy. This is also the case for anyone that we share your information with and who carries out services on our behalf. When we no longer need to use your information and there is no need for us to keep it to comply with our legal or regulatory obligations, we’ll either remove it from our systems or depersonalize it so that we can't identify you.
California Consumer Rights Notice
Under California Civil Code Section 1789.3, California users of the Services receive the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted https://www.dca.ca.gov/
Users of the Services who are California residents and are under 18 years of age may request and obtain removal of User Content they posted by contacting us at: privacy@vaptales.com All requests must be labeled "California Removal Request" on the email subject line. All requests must provide a description of the User Content you want removed and information reasonably sufficient to permit us to locate that User Content. We do not accept California Removal Requests via postal mail, telephone or facsimile. We are not responsible for notices that are not labeled or sent properly, and we may not be able to respond if you do not provide adequate information.
The California Consumer Privacy Act (CCPA) requires us to disclose categories of Personal Information we collect and how we use it, the categories of sources from whom we collect Personal Information, and the third parties with whom we share it, which we have explained above. In the preceding twelve months, we have collected Personal Information from you, your devices, our partners, third parties, and from categories of sources otherwise described in the above section of this Privacy Policy. We are also required to communicate information about rights California residents have under California law. You may exercise the following rights: Right to Know and Access. You may submit a verifiable request for information regarding the: (1) categories of Personal Information we collect, use, or share; (2) purposes for which categories of Personal Information are collected or used by us; (3) categories of sources from which we collect Personal Information; and (4) specific pieces of Personal Information we have collected about you. Right to Equal Service.
We will not discriminate against you if you exercise your privacy rights. Right to Delete. You may submit a verifiable request to close your account and we will delete Personal Information about you that we have collected. In order to verify your identity when you make a request, you will be required to log in to your password-protected account or respond to an email verification request. In addition to above, we may also collect Internet or electronic network activity information, such as information about your device and your use of our Services Geo-location data, when shared through your device settings or photos Electronic, visual, or similar information, such as your profile picture or photos Inferences we draw or derive about users, such as your interests or preferences.
Other information you provide, such as your Posts, likes, and dislikes. We use and disclose this information for the business purposes described in the above section in this Privacy Policy, including to: provide our Service, communicate with you to provide updates or respond to your comments and questions, audit our Service, detect security incidents and prevent fraud, debug and repair errors, maintain your account, provide customer service, process or fulfill orders, conduct research and development and other activities to improve our Service, show advertising, market our Services, and understand how users interact with our Services.
